Well we have still been searching and nothing has turned up yet we feel someone may be holding him as dog wardens are not operating properly during the holidays we have had no luck contacting the people who found the dog in north london and are going to phone our dog wardens after the holidays and re-check the kennels is their anything we can do to have a closer inspection on the dog found in north london?

TO THE FINDERS: If you suspect that the dog you have been given belongs to these poor people, then LET THEM SEE HIM. The dog will SHOW YOU if they are his loving owners!

If you love something- set it free. If it comes back to you....it's YOURS, but if it doesn't.....it NEVER was.

You have no right to keep this dog from his owners. You are causing a great deal of suffering to both owners and the dog.

Give them a chance to see if the dog IS theirs. Do the right thing.

right - we think that this dog should have been reported to Barnet dog warden 0208 359 46 00 - they may not be at work till after the break but you can try

what we would like to just do is to phone the dog warden that they say they have contacted and confirm that the dog is not our dog and was found on the day they said it was which was the 4th i say this because they seemed to nervous to even give us the name of the dog warden they called and tell us that they did get the documentation to keep the dog as foster carers because the foster carers would also allow owners to see the dog just as the same as the kennels would.

Jayne the Dog ID is - 35064 The dog was found in N11 in north London which is a bit of a way from Northampton shire but it is a spitting image of our boy Sargent and was registered on the same day we lost our dog even though the claim is that the dog was found 2 day's before. However the person who originally found the Dog gave it away to her friends.

Angus this is what i believe aswell because the person i spoke to on the phone didnt seem to care that the dog was lost only that they had found him and that the dog seemed "happier" i did a comparison with the dog and my dog and the orginal founder even said hey looked very similar and when i phoned the people with the dog she couldnt speak very good english and she also said that she would not allow us to visit the dog or even give us a refference to where the dog was reported lost to and which dog warden was contacted. the orginal finder of the dog posted the dog on dog lost but did not report it to the wardens,She then handed the dog to her friends as "foster parents" however the people who took the dog from her i feel didnt contact the dog warden and thats why their so nervous is their any way possible that we could at least just see this dog cause my younger sister is upset as it is her first dog and she has a strong feeling this could be our boy.Last edited: 2011-12-25 13:58:53 by imissmydog

Interesting. If the finder does call the dog warden after 7 days of reporting the dog and nothing is provided by the warden what happens then?

The person calling doesn't know the procedure but the warden does. Also if you call the warden and they don't record the find who is at fault? The finder has done everything by law but it looks like they can be punished because the dog warden is not doing their job properly.

These people have probably done everything right but have been ill advised by the dog warden on what to do next. With only phone conversations there is little proof the dog had been reported.

Now is it the wardens fault or the person calling it in?

If a dog is found and handed or reported to the dog warden then one of 2 possibles start - in if in kennels then after 7 days the dog becomes the property of the kennels who can then re-home or send to rescue or sometimes pts, if the finder wishes to retain the dog at home this is the law :
If you wish to keep a stray dog you are legally required to notify the dog warden. You will be asked to sign a form agreeing to keep the dog for a minimum of 1 month unless claimed by the original owner. If, within this time you decide are you no longer able to keep the dog it must be handed over to the dog warden. You must not give the dog to family or friends because in the case of a dog being retained by the finder, the dog legally remains 'found property' and the original owner can reclaim it at any time. Therefore, the dog never truly becomes the property of the finder.

THE PROBLEM IN THIS CASE is that the finder appears to have not contacted the dog warden and thinks wrongly that after 7 days the dog is theirs - actually they can be found guilty of THEFT BY FINDING and could be persued by the law for this offence - this is what the owners are trying to establish with the wardens if the dog was ever reported as found to the warden service as he has not passed through either local stray kennels

The problem I have found is that if you don't contact the dog warden within 7 days the dog is automatically re-homed (if suitable). I hate to think what they do if they decide it is not suitable. Sometimes they ask the finder to look after the dog and after 7 days they hope the finder re-homes the dog. I don't think there is anything you can do once the 7 days has passed, even if it is your dog you must have called the dog warden in that 7 days.

I am so sorry that your dog is missing. Just a thought - but if you think you know where the dog is being kept could you get the police involved and ask them to pay a visit to check the dog out ? I hope that you have some good news soon x

That is exactly what we have done JD. the first time we rang the number the person was very nervous and unhelpful with giving us any information on the found dog. we asked for a refference to where the dog the found was registered to and which local dog warden was contacted as because you just stated it is law to report a found dog. however the person rudely hung up the phone and said that because it had been 7 days since i had first phoned they can keep the dog. i feel very sad because i would at least just like to see the dog with my sister to just confirm its not him however the person seems very attached to this dog we believe could be ours.

I haven't seen a male staffy matching this description in either of the kennels that I visit, I am sorry. I strongly suggest you follow Angus's advice and contact dog warden to see if a found dog was reported to them matching his description as it is the law to report a found dog.

We have contacted the finders and they passed us on to another number who they had given the dog to. We have called them and they intend on keeping the dog even though we strongly believe this is our dog they have refused to let us see the dog so we are taking things further. sadly they want to keep a dog which does not belong to them

owner called me about an hour ago - we got cut off but I think this is a private finder rather than kennels - I have been looking for Sargent at he kennels but have not seen him and I think that JD would have spotted if he had been in coventry kennels - have suggested that he tries to get more info from dogwarden to see if the found dog has been through the stray system legally or if someone has found and not followed the correct procedure
