  • Other Info My wife and I seperated for a while and because of this she arranged with a lady who runs a rescue from her home to look after Lucky for a week. She then made allegations that he was maltreated and wasnt going to give him back. When we tried to speak with her she would refuse. We have just found out that she has given Lucky to new owners without our knowledge, permission etc and we want him back desperately.

This dog has been found today in a bit of a state and looks like Lucky Found in Denton Burn Newcastle. Hi I have no doubt that Lucky will be safe, he is just not safe with his rightful owners and that really upsets me.

I only lost my mum 9 months ago and now I am having to deal with this.

I have not commented before as this is not our usual " lost dog". Please do not give up yet, have you contacted the Echo? maybe they would publish an apeal for his whereabouts? Even if he was legaly rehomed at least you would know that he is safe.

Solicitor i rang doesnt seem to care, the police aint going to be bothered so I have given up any hope of getting Lucky back.

Mmm ok, the fact that you got him from her in the first place may change things. I don't know enough about rescues to comment on how they work but I know when I went to rescue my dog, i'm pretty sure one of the terms and conditions was that she remains the property of the rescue which would then make it a civil case. You could always have a look for someone who deals with civil disputes and just ask for their advice and see where you stand.
It can't be right though that you pay someone to look afer your dog for a week and when they refuse to give it back there is nothing you can do about it!!

ML, Yes she is the person we originally got Lucky from and we paid £150 "donation" for him.

I will try the police again and hopefully they will look into it for me.
What kind of solicitor do I need to find?

Is she the person that you originally got him from?
Obviously I don't know the full circumstances but can I suggest that you go into a police station making sure you speak to a police officer and insist that they look into this. Also, you could always try getting some legal advice from a solicitor. A lot of them offer a half hours free consultation. Good luck.

ML, I rang and spoke to the lady within a couple of days of me finding out that she had him to be told by her that she couldn't speak to me as I didnt sign for Lucky when we first got him. She also said that she wasnt giving him back due to him being maltreated.

She was paid the £50 when she collected Lucky for the week she was going to look after him.

Hi, Can I just ask- how long after Lucky was left with this woman did you try to go and get him? I have just been talking to my husband who is a police officer and he states that if it was a case of you tried to pick Lucky up on the day that you told this lady you would having paid her and she refused to give him back then it is a sraight forward theft for which the police have to take action.
That would not be a civil matter!

It might be an idea to email the link to Lucky's doglost poster to the vets in the area as well. Perhaps they can display it for you to raise awareness and would let them see what he looks like. If I were the new owner I would be horrified to find out how he'd been aquired and sold on without permission... it would make him too hot too handle! Good luck getting him back, at least he's not out there in the cold!

Your other options dmp1967 would be to contact your local newspapers, see if they will run a story with picture of Lucky or place an advert in the papers as Missing/Stolen. Nice of the police to be so helpful !!! I would keep onto them until they at least offer to visit this lady.Last edited: 2011-02-22 14:03:12 by doglover1

ML the police said that its not a matter for them its a civil matter and that if I went to the lady's house I would get arrested for breach of the peace.

The company that we used to get him chipped with have apparently contacted all vets etc in a 30 mile radius.

If it were me I would take the ladies details to the police as in my eyes this is theft!! Lucky is chipped and belongs to you! Like ML said also contact the dogwarden see if they can help, also contact as many vets in the area as possible, give them Lucky's poster to display so they can look out for him. Doglover1 the lady took him on January 3rd 2011. My wife says that she didnt sign anything and that she just asked for Lucky to be looked after for a week.

I have the address and phone number of the lady but I dont know if I can put it on here.

The lady (her name is Wendy) was given £50 - £20 for a haircut and £30 for food.

We had purposely left Lucky's hair a bit longer than usual because it had been really cold and snowy, and he didnt like the cold.Last edited: 2011-02-22 13:28:13 by dmp1967

Hi dmp1967, When did Lucky go to this lady/rescue just so we know a date he has been missing since and did you sign him over to her ie contract or was she just looking after him ? also make sure you advise his chip company he is missing/stolen. I will share Lucky's missing details on Facebook and I have also sent his details to Waggy Tails Rescue and Dorset Dog Rescue in the area. I hope this little fella is home soon. Sorry I am new to all this so how do I check out what Spindle has posted on 28151? I did notice it said female though and Lucky was definately a boy as we had him neutered.

What a terrible situation, great to see Lucky is chipped, this will prove ownership so long as your contact details with the chip co are uptodate. Unless you've signed a contract with this 'rescue' lady she has committed theft so you need to report this to your local police. I would also report to you Dog Warden as this situation is not acceptable. Good luck in your search for your little chap.
